1. Introduction & Acceptance of Terms

Welcome to FitFreaker. These Terms & Conditions ("Terms", "Agreement") govern your access to and use of the FitFreaker mobile application, web portal, services, and software solutions provided and operated by TECHTHRIVE SOLUTIONS PRIVATE LIMITED ("Company", "we", "us", or "our").

By downloading, installing, accessing, or using the FitFreaker platform, you enter into a legally binding agreement with TECHTHRIVE SOLUTIONS PRIVATE LIMITED. If you do not agree to these Terms, you must not access or use our Services.

2. Eligibility & Account Registration

• Age Requirement: You must be at least 18 years old (or the legal age of majority in your jurisdiction) to register an account. Minors between 13 and 17 may use the Services only under parent or legal guardian supervision.
• Account Security: You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You agree to notify us immediately of any unauthorized access.
• Accurate Information: You agree to provide true, accurate, current, and complete registration and profile information.

3. Subscriptions, Payments & Renewal Terms

• Fees: Premium features, coaching plans, video consultations, and event registrations are subject to paid fees as displayed in the app.
• Payment Processing: Payments are securely processed through third-party payment gateways. The Company does not directly store sensitive financial details such as full credit card CVVs.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled at least 24 hours prior to the renewal date via account settings or app store subscription controls.
• Refunds: All payments are non-refundable except where explicitly required by law or specified under our Refund & Cancellation Policy.

4. User Conduct & Acceptable Use Policy

Users agree NOT to perform any of the following restricted actions:

• Share false, offensive, defamatory, harassing, or inappropriate content on community feeds or chat.
• Attempt to reverse-engineer, decompile, crawl, or extract source code from the FitFreaker platform.
• Use automated bots, scrapers, or exploits to access user data or compromise platform infrastructure.
• Impersonate personal trainers, staff members, or other users.
• Engage in off-platform commercial solicitation or spamming other members.

5. Intellectual Property Rights

All software design, source code, logos, trademarks, UI elements, workout modules, and content provided on FitFreaker are the exclusive intellectual property of TECHTHRIVE SOLUTIONS PRIVATE LIMITED. Users are granted a limited, non-exclusive, non-transferable, revocable license to access the platform for personal use.

6. Events, Competitions & Outdoor Activities

FitFreaker facilitates participation in physical events, body transformation challenges, treks, and competitions. Participation in outdoor activities involves inherent physical risk. By joining these events, participants voluntarily assume all associated risks and agree that TECHTHRIVE SOLUTIONS PRIVATE LIMITED is not liable for personal injury, property loss, or damage incurred during third-party or platform-coordinated events.

7. Limitation of Liability & Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, TECHTHRIVE SOLUTIONS PRIVATE LIMITED disclaims all warranties, express or implied. Under no circumstances shall the Company be liable for indirect, incidental, consequential, or punitive damages arising out of your platform usage.

8. Termination & Suspension

We reserve the right to suspend or terminate your account immediately, without prior notice, if you breach any provision of these Terms or engage in conduct deemed harmful to the platform or community.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes or legal proceedings arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in the registered entity's jurisdiction.
